RESOLUTION No. 36/2000/QH10 OF JUNE 9, 2000 ON THE RATIFICATION OF THE LAND BORDER AGREEMENT BETWEEN THE SOCIALIST REPUBLIC OF VIETNAM AND THE PEOPLE�S REPUBLIC OF CHINA THE NATIONAL ASSEMBLY OF THE SOCIALIST REPUBLIC OF VIETNAM Pursuant to Article 84 of the 1992 Constitution of the Socialist Republic of Vietnam; At the proposal of the State President; After considering the report of the Government, the report of the National Assembly�s Committee for External Affairs, and the opinions of National Assembly deputies on the ratification of the Land Border Agreement between the Socialist Republic of Vietnam and the People�s Republic of China, RESOLVES: 1. To ratify the Land Border Agreement between the Socialist Republic of Vietnam and the People�s Republic of China. 2. The Socialist Republic of Vietnam reaffirms its determination together with the People�s Republic of China to build the Vietnam-China borderline into a peaceful, stable and permanent one, contributing to preserving and developing the traditional neighborly and friendly relationship between the two countries on the basis of respect for each other�s independence, sovereignty and territorial integrity, non-infringement upon each other, non-interference in each other�s internal affairs, equality, mutual benefit and peaceful co-existence. 3. To assign the Government to direct the competent agencies to deploy soon necessary tasks in order to sign a protocol on demarcation and placing of border markers and on determination of detailed maps; to allocate budgets for the Agreement�s implementation; to amend and supplement the current regulations relating to the management of borderlines and administrative boundaries, soon stabilizing the life of people living in border areas; together with concerned competent authorities of the People�s Republic of China to strictly implement the Agreement and properly and promptly deal with any problems that arise. The Government shall proceed with external procedures for ratifying the Agreement and notify and guide the concerned agencies to implement this Agreement. This Resolution was passed on June 9, 2000 by the X th National Assembly of the Socialist Republic of Vietnam at its seventh session. Chairman of the National Assembly NONG DUC MANH THE LAND BORDER AGREEMENT BETWEEN THE SOCIALIST REPUBLIC OF VIETNAM AND THE PEOPLE�S REPUBLIC OF CHINA The Socialist Republic of Vietnam and the People�s Republic of China (hereinafter referred to as "the two signatories"); looking forward to preserving and developing the traditional neighborly and friendly relationship between the two countries and two peoples of Vietnam and China; desirous to build a peaceful, stable and permanent border between the two countries; on the basis of respect for each other�s independence, sovereignty and territorial integrity, non-infringement upon each other, non-intervention in each other�s internal affairs, equality, mutual benefit and peaceful co-existence; in the spirit of mutual sympathy and concession and friendly consultation; have decided to sign this Agreement and agreed on the following provisions: Article I. The two signatories, having taken the historical conventions on the current border between Vietnam and China as foundations and based themselves on the recognized international legal principles as well as the agreements reached in the process of negotiation on Vietnam-China border issues, have settled their border issues in a fair and reasonable manner and re-determined the land borderline between the two countries. Article II. The two signatories have agreed that the land borderline between the Socialist Republic of Vietnam and the People�s Republic of China is defined in the west-to-east direction as follows: Marker point No. 1 is situated at the point with an elevation of 1875 of Khoan La San mountain (Thap Tang Dai Son), which is about 2.30 km west-northwest of the point with an elevation of 1439 in the Vietnamese territory, about 3.70 km west-northwest of the point with an elevation of 1691 in the Vietnamese territory, and about 2.00 km south of the point with elevation of 1203 in the Chinese territory. From marker point No. 1, the borderline follows the watershed between the upstream creeks of Nam Mo Phi and Nam Sa Ho rivers flowing into the Vietnamese territory and the upstream creeks of Chinh Khang river flowing into the Chinese territory in the general direction of north-northeast to east, passing through the points with elevations of 1089, 1275 and 1486 to the point with an elevation of 1615, thence continues to follow the above-said watershed in the general direction of north to northeast, passing through the point with an elevation of 1221 to the point with an elevation of 1264, thence follows the mountain crest southeastwards to the point with an elevation of 1248, thence follows a small mountain crest northeastwards to marker point No. 2. This marker point is situated in the middle of Nam Nap (Thap Noa) river, about 0.70 km southwest of the point with an elevation of 1369 in the Vietnamese territory, about 0.87 km northwest of the point with an elevation of 1367 in the Vietnamese territory, about 0.80 km east-southeast of the point with an elevation of 1256 in the Chinese territory. From marker point No. 2, the borderline runs downstream Nam Nap (Thap Noa) river in the direction of north to northeast to its confluence with Ta Lo Phi Ma (Nam Ma) river, thence continues to run downstream the river northwards to its confluence with Da (Ly Tien) river, thence follows Da (Ly Tien) river eastwards to its confluence with Nam La (Tieu Hac) river, thence runs upstream Nam La (Tieu Hac) river to marker point No. 3. This marker point is situated at the confluence between Nam La (Tieu Hac) river and Nam Na Pi stream, about 1.87 km west-southwest of the point with an elevation of 978 in the Vietnamese territory, about 0.50 km north-northwest of the point with an elevation of 620 in the Chinese territory, and about 4.40 km east-northeast of the point with an elevation 1387 in the Chinese territory. From marker point No. 3, the borderline leaves the river and joins up with a mountain crest northwestwards to the point with an elevation of 1933, thence follows the watershed between the upstream creeks of La Po, La Si, A Hu, Nam Sau, Nam Kho Ma, Nam Ha Xi, Nam Ha Ne, Nam Xi Lung, Nam Ha, Nam Nghe, Nam Den Thang and Nam Pang streams flowing into the Vietnamese territory and the upstream creeks of Zhe Dong, Ha Luo Luo Ba, Da Tou Lou Ba, Mo Wu Luo Ba, Na Bang, Ge Jie, Da Luo, Nan Bu, Xiao Weng Bang, Qiao Cai Ping, Nan Yan and Jin Shui rivers flowing into the Chinese territory, in the general direction of northeast to southeast, then northeast, passes through the points with elevations of 1690, 1975, 1902, 2121, 2254, 2316, 1831, 3074, 2635, 2199, 2133, 2002, 1800 to the point with an elevation of 1519, thence runs along the mountain crest in the general easterly direction to an unnamed mountain summit, thence follows a small mountain crest eastwards to marker point No. 4. This marker point is situated in the middle of Nam Le (Cach Gioi) stream, about 2.05 km north-northeast of the point with an elevation of 1451 in the Vietnamese territory, about 2.90 km southeast of the point with an elevation of 845 in the Chinese territory and about 1.62 km southwest of the point with an elevation of 1318 in the Chinese territory. From marker point No. 4, the borderline runs downstream Nam Le (Cach Gioi) stream in the general direction of northeast to northwest to its confluence with Nam Na river, thence runs downstream Nam Na river in the direction of southeast to east to its confluence with Nam Cum (Dang Dieu) river, thence goes upstream Nam Cum (Dang Dieu) river in the general northeasterly direction to the head of Phi Ho (Dang Diem) stream, thence follows a small ravine in the general east-northeasterly direction to marker point No. 5. This marker point is situated at the adjoining point of the above-said ravine and the mountain crest, about 0.62 km east-northeast of the point with an elevation of 2283 in the Vietnamese territory about 0.45 km south-southeast of the point with an elevation of 2392 in the Chinese territory, and about 1.50 km west of the point with an elevation of 2361 in the Chinese territory. From marker point No. 5, the borderline runs along the mountain crest southwards to the point with an elevation of 2413, thence follows the watershed between Ta Pao Ho, Then Theo Ho, Panh Ho, Nam Nung and Nam Lon streams in the Vietnamese territory and San Cha, Tai Yang Zhai, Man Jiang, Wu Tai, Shi Dong, Ping, Zhong Liang and Cha rivers in the Chinese territory in the general southeasterly direction, passes through the points with elevations of 2468, 3013, 2539 and 2790 to marker point No. 6. This marker point is situated at the point with an elevation of 2836, about 1.40 km north of the point with an elevation of 2381 in the Vietnamese territory, about 3.00 km east-northeast of the point with an elevation of 2531 in the Vietnamese territory, and about 3.05 km south-southwest of the point with an elevation of 2510 in the Chinese territory. From marker point No. 6, the borderline runs along the mountain crest southwestwards to a point in the vicinity of the saddle northeast of the point with an elevation of 2546 in the Vietnamese territory, thence follows a ravine southeastwards to the head of Lung Po (Hong Nham) stream, thence goes downstream Lung Po (Hong Nham) stream and along its lower creek in the general northeasterly direction to its confluence with the Red river, thence the borderline runs downstream the Red river southeastwards to its confluence with Nam Thi (Nam Khe) river, thence runs upstream Nam Thi (Nam Khe) river in the general northeasterly direction to its confluence with Ba Ket (Ba Cat) river, thence goes upstream Ba Ket (Bat Tu) river in the general northerly direction to its confluence with an unnamed stream tributary, thence runs upstream such unnamed stream northwards to marker point No. 7. This marker point is situated in the middle of the above-mentioned unnamed stream tributary, about 2.00 km northwest of the point with an elevation of 614 in the Vietnamese territory, about 1.20 km northeast of the point with an elevation of 595 in the Chinese territory, and about 0.65 km east of the point with an elevation of 463 in the Chinese territory. From marker point No. 7, the borderline leaves the stream northeastwards to the point with an elevation of 143, thence runs in the northeasterly direction, cuts through a ravine, joins up with a mountain crest in the northerly direction, passes through the points with elevations of 604, 710, 573, 620, 833, 939 and 1201 to the point with an elevation of 918, thence follows the watershed line between the river creeks in the Vietnamese territory and the river creeks in the Chinese territory in the general northeasterly direction, passes through the points with elevations of 1158, 1077, 997, 1407, 1399, 1370, 1344, 1281, 1371, 1423, 1599, 1528, 1552, 1372, 1523 and 1303 to the point with an elevation of 984, thence follows a small mountain crest in the general southerly direction to marker point No. 8. This marker point is situated at the confluence between Xanh (Qua Sach) river and one of its western creeks, about 3.85 km east of the point with an elevation of 1521 in the Vietnamese territory, about 3.82 km south-southwest of the point with an elevation of 1346 in the Chinese territory, and about 2.27 km west-northwest of the point with an elevation of 1596 in the Chinese territory. From marker point No. 8, the borderline runs along Xanh (Quan Sach) river in the general southerly direction to its confluence with and Chay river, thence upstream Chay river in the general southeasterly direction to marker point No. 9. This marker point is situated at the confluence between Chay river and Xiao Bai river, about 2.95 km east of the point with an elevation of 1424 in the Vietnamese territory, about 2.00 km northeast of the point with an elevation of 1031 in the Vietnamese territory, and about 1.40 km south of the point with an elevation of 1076 in the Chinese territory. From marker point No. 9, the borderline leaves the river and joins up with a mountain crest, thence goes along the mountain crest in the general southeasterly direction, passes through the point with an elevation of 741 to the point with an elevation of 1326, thence goes along the watershed between the creeks of Chay river flowing into the Vietnamese territory and the creeks of Xiao Bai river flowing into the Chinese territory in the general northeasterly direction, passes through the points with elevations of 1681, 1541, 1716, 2002 and 1964, an unnamed mountain summit (Dai Nham Dong) to the point with an elevation of 1804, thence follows the red line on the map attached to the Agreement to the point with an elevation of 1623, thence goes along the watershed line between Nan Xin stream in the Vietnamese territory and Xiao Bai river in the Chinese territory northeastwards, passes through the point with an elevation of 1638 to the point with an elevation of 1661, thence runs along a ravine northeastwards down to the middle of Ho Pa stream, thence goes downstream this stream to its confluence with one of its creeks, thence leaves the stream and joins up with the mountain crest, thence follows the mountain crest west-northwestwards and passes through the point with an elevation of 1259 to marker point No. 10. This marker point is situated at a mountain crest, about 1.25 km north-northwest of the point with an elevation of 1461 in the Vietnamese territory, about 0.90 km east of the point with an elevation of 1692 in the Chinese territory, and about 2,10 km south of the point with an elevation of 1393 in the Chinese territory. From marker point No. 10, the borderline goes along the red line on the map attached to the Agreement to the point with an elevation of 948, thence along a mountain crest in the direction of northeast to east, passes through the point with an elevation of 1060 to marker point No. 11. This marker point is situated at the confluence between Do (Nam Bac) stream and its southwestern creek (Qua Giai), about 0.70 km northeast of the point with an elevation of 841 in the Vietnamese territory, about 1.50 km southeast of the point with an elevation of 982 in the Chinese territory, and about 1.15 km south-southwest of the point with an elevation of 906 in the Chinese territory. From marker point No. 11, the borderline goes along Do (Nam Bac) stream to its confluence with Nam Cu (Nam Giang) stream, thence upstream Nam Cu (Nam Giang) stream to marker point No. 12. This marker point is situated at the confluence between Nam Cu (Nam Giang) stream and its northwestern creek, about 2.80 km north-northwest of the point with an elevation of 1151 in the Vietnamese territory, about 1.40 km southeast of the point with an elevation of 986 in the Chinese territory, and about 0.80 km west of the point with an elevation of 858 in the Chinese territory. From marker point No. 12, the borderline leaves the stream and joins up with a mountain crest, thence goes along the mountain crest in the general southeasterly direction, passes through the point with an elevation of 1071 to the point with an elevation of 1732, thence along the watershed between the river creeks in the Vietnamese territory and the river creeks in the Chinese territory in the general direction of east to north then northeast, passes through the points with elevations of 1729, 2071, 1655, 1705, 1423 to marker point No. 13. This marker point is situated at an unnamed mountain summit, about 1.55 km west-northwest of the point with an elevation of 993 in the Vietnamese territory, about 1.15 km north-northwest of the point with an elevation of 1044 in the Vietnamese territory, and about 0.70 km southeast of the point with an elevation of 1060 in the Chinese territory. From marker point No. 13, the borderline continues to run along the above-mentioned watershed eastwards to a point about 70 m southwest of the point with an elevation of 1422, thence follows the red line on the map attached to the Agreement to a point lying on the watershed and about 90 m north-northeast of the point with an elevation of 1422 (an area of 7,700 m 2 lying between the above-mentioned red line and the watershed belonging to China), thence the borderline continues to follow the above-mentioned watershed in the general easterly direction and passes through the points with elevations of 1397, 1219, 657 and 663 to an unnamed mountain summit southeast of this point, thence goes along a ravine northwards to Na La stream, thence goes downstream this stream northeastwards to marker point No. 14. This marker point is situated at the confluence between Na La stream and Lo (Pan Long) river, about 3,20 km west-northwest of the point with an elevation of 922 in the Vietnamese territory, about 0.50 km north-northeast of the point with an elevation of 183 in the Vietnamese territory, and about 0.65 km east of the point with an elevation of 187 in the Chinese territory. From marker point No. 14, the borderline follows the red line on the map attached to the Agreement, passes through the point with an elevation of 428 to the saddle between the point with an elevation of 1169 in the Vietnamese territory and the point with an elevation of 1175 in the Chinese territory, thence goes along a mountain crest in the general direction of north to northwest, passes through the points with elevations of 1095, 1115, 1022, 1019, 1094, 1182, 1192, 1307, 1305 and 1379 to the point with an elevation of 1397, thence continues to go along the mountain crest in the general northerly direction, passes through the points with elevations of 1497, 1806, 1825, 1952, 1967, 2122 and 2038 to marker point No. 15. This marker point is situated at an unnamed mountain summit about 2.90 km northwest of the point with an elevation of 1558 in the Vietnamese territory, about 1.55 km east of the point with an elevation of 2209 in the Chinese territory, and about 1.70 km south-southwest of the point with an elevation of 2289 in the Chinese territory. From marker point No. 15, the borderline goes along the mountain crest in the general easterly direction, passes through the point with an elevation of 2076, after cutting across a stream, to an unnamed mountain summit, thence follows the red line on the map attached to the Agreement, passes through the points with elevations of 1887 and 1672 to the point with an elevation of 1450, thence goes along the mountain crest in the general direction of south to east, and north to northeast, passes through the points with elevations of 1438, 1334, 716 and 1077 to marker point No. 16. This marker point is situated at the point with an elevation of 1592, about 2.40 km north of the point with an elevation of 1079 in the Vietnamese territory, about 3.25 km southeast of the point with an elevation of 1026 in the Chinese territory, and about 1.05 km west-northwest of the point with an elevation of 1521 in the Chinese territory. From marker point No. 16, the borderline goes along the mountain crest in the general direction of southeast to north, passes through the points with elevations of 1578, 1503, 1493, 1359, 1342 and 1296 to the point with an elevation of 606, thence goes along a small mountain crest in the direction of north-northwest to northeast to marker point No. 17. This marker point is situated in the middle of Mien (Babu) river, about 3.30 km northwest of the point with an elevation of 654 in the Vietnamese territory, about 4.10 km north-northwest of the point with an elevation of 1383 in the Vietnamese territory, and about 1.70 km south-southeast of the point with an elevation of 882 in the Chinese territory.
