DECISION Approving the Plan on organization of the implementation of the Kyoto Protocol under the United Nations framework Convention on climate change in the 2007-2010 period THE PRIME MINISTER Pursuant to the December 25, 2001 Law on Organization of the Government; At the proposal of the Minister of Natural Resources and Environment, DECIDES: Article 1.- To approve the Plan on organization of the implementation of the Kyoto Protocol under the United Nations Framework Convention on Climate Change in the 2007-2010 period with the following principal contents: I. OBJECTIVES 1. To mobilize all resources to contribute to implementing the country's socio-economic development plan for the 2007-2010 period in a fast, sustainable and environment-friendly manner and organizing the implementation of the United Nations Framework Convention on Climate Change (hereinafter referred to as Climate Convention), the Kyoto Protocol under the United Nations Framework Convention on Climate Change (hereinafter referred to as Kyoto Protocol) and the Clean Development Mechanism (CDM). 2. To make the utmost use of the rights and benefits which the Climate Convention and Kyoto Protocol grant to developing countries. 3. To attract domestic and overseas investment in CDM projects and encourage technological renewal, and take-over and application of high technology, clean technology and modern techniques. 4. To contribute to managing, exploiting and properly and efficiently using natural resources, protecting natural resources, the environment and climate, and reducing greenhouse gas emissions. II. TASKS 1. To elaborate and complete the legal framework and legal documents regarding the Climate Convention, Kyoto Protocol and CDM. 2. To propagate, raise awareness, train human resources, improve organization and increase material bases for the implementation of the Climate Convention, Kyoto Protocol and CDM. 3. To enhance activities of basic surveys and scientific research in service of the implementation of the Climate Convention, Kyoto Protocol and CDM. 4. To enhance and raise the efficiency of international cooperation on the Climate Convention, Kyoto Protocol and CDM. 5. To plan and organize activities of implementing the Climate Convention, Kyoto Protocol and CDM in various sectors with a view to promoting environmental protection and socio-economic development. III. PLAN OF ACTION The tasks, activities, implementing agencies, coordinating agencies and implementation schedules of the plan of action for implementing the Kyoto Protocol under the United Nations Framework Convention on Climate Change in the 2007-2010 period are specified in the list promulgated together with this Decision. Article 2.- Organization of implementation 1. The Ministry of Natural Resources and Environment shall assume the prime responsibility for the Plan on organization of the implementation of the Kyoto Protocol under the United Nations Framework Convention on Climate Change in the 2007-2010 with the following tasks: a/ To guide, check and supervise the implementation of this Plan by ministries, branches and localities; and act as the national key agency in coordinating with international organizations. b/ To coordinate with the Ministry of Planning and Investment, the Ministry of Finance and relevant ministries and provincial/municipal People's Committees in integrating tasks and projects in accordance with this Plan. c/ To collaborate with the Ministry of Finance and relevant agencies in adopting a financial regulation on the use of funds for the Plan to ensure efficient, lawful and strict management. d/ To appraise, and participate in the appraisal of, specific projects. e/ To annually report to the Prime Minister on results of the Plan's implementation; and promptly report to the Prime Minister on arising problems which fall beyond its competence. 2. Ministries, ministerial-level agencies and government-attached agencies are, within the ambit of their functions, responsibilities and powers, responsible for guiding and raising their member units' awareness about the Kyoto Protocol and CDM implementation; promptly study amendments and supplements to, and promulgate or submit to competent authorities for promulgation, mechanisms and policies on CDM implementation under their management; actively integrate CDM implementation activities into their short-, medium- and long-term development strategies, plans and programs; elaborate CDM projects and submit them to competent authorities for approval and organize performance of the assigned tasks under this Plan. 3. Provincial/municipal People's Committees are, under the guidance of the Ministry of Natural Resources and Environment and relevant ministries, responsible for raising the awareness of agencies, organizations and enterprises operating in their localities about the Kyoto Protocol and CDM implementation; actively integrate CDM implementation activities into local development strategies, plans and programs; instruct and facilitate agencies, organizations and enterprises to devise CDM projects under their management and submit them to competent authorities for approval and organize performance of the assigned tasks under this Plan. 4. Enterprises, organizations and individuals engaged in relevant production and business activities shall study, renew equipment and apply environment-friendly high technologies to contribute to greenhouse gas emission reduction and sustainable socio-economic development and prepare conditions to receive and implement CDM projects. 5. Funds for the implementation of the contents specified in Section III of this Plan shall be included in the annual budget estimates of ministries, branches and localities in accordance with the State Budget Law. Article 3.- This Decision takes effect 15 days after its publication in "CONG BAO." Article 4.- Ministers, heads of ministerial-level agencies, heads of government-attached agencies, and presidents of provincial/municipal People's Committees shall implement this Decision.
