DECISION Approving the adjustment to the general planning on construction of Hoa Lac hi-tech park THE PRIME MINISTER Pursuant to the December 25, 2001 Law on Organization of the Government; Pursuant to the Prime Minister's Decision No. 198/1998/QD-TTg of October 12, 1998, on the establishment of Hoa Lac Hi-Tech Park and approval of its master plan and investment projects, step 1, phase I; Pursuant to the Government's Decree No. 99/2003/ND-CP of August 28, 2003, promulgating the Regulation on Hi-Tech Parks; At the proposal of the Ministry of Construction in Report No. 46/TTr-BXD of June 24, 2005, applying for approval of the adjustment to the general planning on construction of Hoa Lac Hi-Tech Park, DECIDES: Article 1.- To approve the adjustment to the general planning on construction of Hoa Lac Hi-Tech Park with the following main contents: 1. Characteristics Hoa Lac Hi-Tech Park is a delimited multi-functional economic and technical zone, for the purpose of hi-tech research, development and application, nursery of hi-tech enterprises, training of hi-tech human resources, and manufacture of and trading in hi-tech products. 2. Location, scope, boundary and scale of the area under planning a/ Location: To keep unchanged its current location in Hoa Lac urban center, belonging to Ha Bang, Thach Hoa, Tan Xa and Binh Yen communes, Thach That district, Ha Tay province. b/ Boundary: The boundary of Hoa Lac Hi-Tech Park is adjusted as follows: - To the north: It borders on road No. 84; - To the south: It borders on Lang-Hoa Lac Expressway; - To the west: It borders on national highway No. 21; - To the east: It borders on the belt road of Hoa Lac urban center. c/ Land area (by 2020): Around 1,500 ha. 3. Targets and viewpoints of the adjustment - To integrate activities in the hi-tech park with those in other functional quarters of Hoa Lac urban center and its vicinity; to achieve a combination of technical infrastructure systems and architectural space of landscape in the area. - To create favorable conditions for activities in Hoa Lac Hi-Tech Park. - To exploit to the utmost the park's conditions in geographical location and landscape; create an attractive environment for investment; and minimize expenses for investment in technical infrastructure. - To create a legal setting for the execution of construction investment projects as well as planning and construction management in the hi-tech park. - Based on norms on the use of land and technical infrastructure and demands for an advanced and modern hi-tech park, to review and adjust the location, boundaries and land areas of functional zones and infrastructure works so as to meet development demands and concurrently suit management requirements in the immediate future as well as in the long term. - For areas under construction, the approved planning must be strictly observed. - For areas where construction is not yet commenced, detailed plannings must be amended so as to suit this adjustment. 4. Research requirements - To analyze and evaluate the approved general planning and its implementation; and the practical socio-economic issues, population, labor, land use, construction, social and technical infrastructure and environmental sanitation in the area. - On the basis of new elements, to clearly determine inter-regional relations of Hoa Lac Hi-Tech Park and its functional zones, population and land areas. - To study and select the optimum plan on division of functional quarters and the land-use plan. - To propose major econo-technical norms compatible with the particular characteristics of each functional zone in each development period of the hi-tech park. - To set orientations for spatial development of the whole hi-tech park. - To set orientations for development of technical infrastructure systems. - To determine items and projects prioritized for investment and make their capital plans. - To draft a regulation on construction management according to the general planning on Hoa Lac Hi-Tech Park. 5. Major norms of the scheme To base mainly on standards and procedures set by the Vietnamese State. In the course of formulating the adjusted general planning, on the basis of reviewing experience gained from the construction of hi-tech parks in the world, to propose particular econo-technical norms suitable to the characteristics and requirements of each functional quarter and the whole hi-tech park, and to Vietnam's conditions. 6. Major functional quarters On the basis of the approved general planning, to study and propose the setting up of major functional quarters so as to meet objectives and nature of Hoa Lac Hi-Tech Park as stated in this adjusted planning, specifically: - R&D centers, human resource training and development establishments, national key laboratories, and hi-tech enterprise nurseries. - Software parks in service of the software industry nursery and development as well as the production of, and trade in, software products. - A hi-tech industrial park. - A technical cooperation zone, an information and Internet center, and hi-tech transaction and service centers. - A technology-transaction center, a center for international seminars and scientific and technological exhibitions, hotels, banks and commercial zones. - Low-story dwelling houses, high rises, high-class apartment buildings and social infrastructure works. - Entertainment and recreational facilities in combination with a system of parks, green trees and water surfaces. - On the basis of the Government's Decree No. 99/2003/ND-CP of August 28, 2003, promulgating the Regulation on Hi-Tech Park, it is possible to consider and set up an export-processing zone, a tax-guarantee zone and bonded warehouses. 7. Orientations for spatial development - Based on natural, climatic and geographical conditions, landscape and Vietnamese architectural traditions, to suggest solutions for spatial planning and architectural landscape in conformity with the characteristics and requirements of functional quarters. Architectural works must be modern and closely linked to a system of green trees, water surface, traffic networks, geographical conditions and natural landscape. To execute urban landscape designs in major areas. - To study various options on the division of functional quarters, compare and select the optimum one. To determine the boundaries and scope of functional quarters. - To determine the boundaries and scope of underground works. - To determine major econo-technical norms: scope, acreage, construction density, land-use coefficient, and construction height of each functional quarter and the whole hi-tech park. 8. Orientations for development of the technical infrastructure system The technical infrastructure system of the hi-tech park must be designed and built to be modern and of high quality, in line with the common technical infrastructure network of the whole Hoa Lac urban center, and ensuring fine views, safety and environmental sanitation. Specific requirements are: - To determine the construction height limits of each zone and the whole Hoa Lac Hi-Tech Park. - To determine the outbound and inbound traffic networks; the location and scope of traffic terminals; red-line marks of main traffic axes and the system of technical tunnels. It is necessary to refer to JICA's suggestions on the public system and means of transport inside and outside the hi-tech park so as to work out an appropriate plan. - To determine water supply sources, the demand for, and location and scope of water-supply works and pipeline networks, and major technical parameters. - To determine power supply sources, the capacity, load demands, location and scope of power plants, transformers, electricity-transmission corridors and major electricity distribution networks as well as major technical parameters. To ensure absolute safety for production, research, daily-life, and public lighting activities. - To determine the location and scope of wastewater-treating stations, solid waste-treating works and cemeteries; to research into a main water-drainage network, reservoirs and work out solutions for environmental protection. The systems of rainwater and wastewater drainage must be separated. - The telecommunications-Internet infrastructure of Hoa Lac Hi-Tech Park must be planned to be attractive to investors. - To assess environmental impacts and suggest solutions to minimize adverse impacts on the environment. 9. Dossier composition The dossier of the scheme on adjustment to the overall planning on construction of Hoa Lac Hi-Tech Park shall comply with the provisions of Article 17 of the Government's Decree No. 08/2005/ND-CP of January 24, 2005. 10. Organization of implementation - Project-managing agency: The Ministry of Planning and Investment. - Investor: The Hoa Lac Hi-Tech Park Management Board. - Drafters of the project: Foreign consultants, together with fully qualified domestic consultants according to current regulations. - Project-appraising agency: The Ministry of Construction. - Project-approving authority: The Prime Minister. - Project-formulating time: Within 12 months after the planning is approved. Article 2.- 1. To assign the Ministry of Planning and Investment to assume the prime responsibility for, and coordinate with concerned ministries and branches in, formulating the adjustment to the overall planning on construction of Hoa Lac Hi-Tech Park. 2. To assign the Hoa Lac Hi-Tech Park Management Board: To elaborate a plan on budget capital for the formulation of the adjustment to the general planning on construction of Hoa Lac Hi-Tech Park and detailed plannings on functional quarters for submission to competent authorities for approval. Article 3.- This Decision takes effect 15 days after its publication in "CONG BAO." The Ministers of Science and Technology; Construction; Planning and Investment; Finance; Natural Resources and Environment; and Defense, the president of the People's Committee of Ha Tay province, the chairman of the Hoa Lac Hi-Tech Park Management Board, and concerned organizations shall have to implement this Decision.
