RESOLUTION No. 40/2004/QH11 OF DECEMBER 3, 2004 ON THE NATIONAL ASSEMBLY’S 2005 SUPERVISORY ACTIVITY PROGRAM THE NATIONAL ASSEMBLY OF THE SOCIALIST REPUBLIC OF VIETNAM Pursuant to Article 84 of the 1992 Constitution of the Socialist Republic of Vietnam, which was amended and supplemented under Resolution No. 51/2001/QH10 of December 25, 2001 of the X th National Assembly, its 10 th session; Pursuant to the Law on Supervisory Activities of the National Assembly; Having considered the proposals of the Nationality Council and the Committees of the National Assembly, delegations of National Assembly deputies and Vietnam Fatherland Front’s Central Committee, the report of the National Assembly Standing Committee and opinions of National Assembly deputies; RESOLVES: Article 1.- Together with the consideration and examination of reports of the Government, the Supreme People’s Court, the Supreme People’s Procuracy, questions and answers, the National Assembly shall supervise the following contents at various sessions: 1. The implementation of the National Assembly’s Resolution on Dung Quat oil refinery project (at its 7 th session); 2. The promulgation of legal documents of the Government, the Prime Minister, ministries, ministerial-level agencies, the Supreme People’s Procuracy, the Supreme People’s Court (at its 8 th session). Article 2.- To assign the National Assembly Standing Committee to supervise the following contents and report on the results thereof to the National Assembly: 1. The implementation of policy on medical examination and treatment for people (to be reported to the National Assembly at its 7 th session); 2. The results of implementation of policies in support of the development of agricultural and rural economy from 2001 till now (to be reported to the National Assembly at its 8 th session). Article 3.- To assign the Nationality Council and Committees of the National Assembly to supervise the following contents and report on the results thereof to the National Assembly: 1. The implementation of the 2002 State Budget Law from the time it took effect to the time before the elaboration of the 2006 State budget estimates; 2. The results of implementation of the program on socio-economic development in communes meeting with exceptional difficulties, mountainous, deep-lying, remote regions (Program 135); 3. The implementation of policies on labor, vocational training, employment and labor export; 4. The management, protection and promotion of cultural heritage values; 5. The enforcement of intellectual property rights in our country at present; 6. The management of implementation of tasks of ensuring security, social order and safety at a number of border-gates, national borderlines and a number of key strategic locations; 7. The situation of implementation of policies towards overseas Vietnamese and foreigners living and working in Vietnam; 8. The implementation of the National Assembly Standing Committee’s Resolution on compensation for damage caused to persons with injustice done upon by competent persons in criminal proceedings. Article 4.- On the basis of the National Assembly’s supervisory activity program and the law-prescribed tasks and powers, the Standing Committee, the Nationality Council and various Committees of the National Assembly shall take initiative in elaboration and implementation of their respective supervisory activity programs. Article 5.- Based on the contents mentioned in Articles 1, 2 and 3 of this Resolution as well as practical conditions and situation, the delegations of National Assembly deputies and National Assembly deputies shall take initiative in selecting contents for elaboration of programs on supervision and conducting supervision in localities and reporting on supervisory results according to regulations. Article 6.- To assign the National Assembly Standing Committee to direct the implementation of the supervisory activity program of the National Assembly; direct, regulate and coordinate supervisory activities of the Nationality Council, the Committees of the National Assembly; guide the delegations of National Assembly deputies as well as National Assembly deputies in carrying out supervisory activities; direct the work of ensuring the implementation of the supervisory program of the National Assembly; to direct the supervising agencies in monitoring and synthesizing the results of settling petitions. Article 7.- The concerned agencies and organizations shall create favorable conditions for the National Assembly’s agencies, National Assembly deputies’ delegations and National Assembly deputies in conducting the supervision; take initiative in preparing reports and supplying necessary documents at requests of the Standing Committee, the Nationality Council or Committees of the National Assembly, National Assembly deputies’ delegations or National Assembly deputies; seriously handle petitions and report on the results thereof to the supervising agencies. Article 8.- The National Assembly Standing Committee shall consider and make biannual and annual sum-up reports on supervisory activities of various agencies of the National Assembly, and delegations of National Assembly deputies; synthesize and report on results of implementation of the program on supervisory activities of the National Assembly in 2005 at its 8 th session. This Resolution was passed on December 3, 2004 by the XI th National Assembly of the Socialist Republic of Vietnam at its 6 th session. Chairman of the National Assembly NGUYEN VAN AN
