DECREE No DECREE No. 23/2001/ND-CP OF MAY 30, 2001 AMENDING AND SUPPLEMENTING A NUMBER OF ARTICLES OF THE REGULATION ON THE REGISTRATION OF SEA-GOING SHIPS AND CREW MEMBERS, ISSUED TOGETHER WITH THE GOVERNMENT�S DECREE No. 91/CP OF AUGUST 23, 1997 THE GOVERNMENT Pursuant to the Law on Organization of the Government of September 30, 1992; Pursuant to the Vietnam Maritime Code of June 30, 1990; At proposal of the Minister of Communications and Transport, DECREES: Article 1.- To amend and supplement a number of articles of the Regulation on the Registration of Sea-going Ships and Crew Members, issued together with the Government�s Decree No. 91/CP of August 23, 1997 as follows: 1. Article 10a is supplemented as follows: "Article 10a 1. The regional agencies registering sea-going ships and crew members shall grant the temporary certificates of the registration of sea-going ships to the following cases: a) When registering the used sea-going ships purchased from foreign countries for use, but the vessel owners have not yet obtained the certificates of deletion of the ships� registered and the certificate of payment of registration fee, or when buying the newly built ships of foreign countries but the ship owners have not yet obtained the certificates of payment of registration fee as prescribed in Article 10 of the Regulation on the Registration of Sea-going Ships and Crew Members, issued together with the Government�s Decree No. 91/CP of August 23, 1997. b) When registering the newly-built sea-going ships in Vietnam for test run of ships to the place of official registration, the ship owners must submit the copies of the following papers to the regional sea-going ship and crew member registries: - The shipbuilding contract or the contract on the transfer of the ownership over the ships. - Technical safety dossier of ships granted by the Registry. - The permit for using the ship radio granted by the Post office. 2. The temporary certificates of sea-going ship registration granted to ship owners, which shall be valid for 90 days only". 2. Clause 2, Article 24 is amended as follows: " 2. Depending on technical properties of ships and the requirements on specialized qualifications and experience of crew members and in order to ensure the operation safety for each type of sea-going ship, the Minister of Communications and Transport and the Minister of Aquatic Resources (according to Article 4 of the Regulation on the Registration of Sea-going Ships and Crew Members, issued together with the Government�s Decree No. 91/CP of August 23, 1997 ) shall specify the quantity and titles of crew members being foreign citizens allowed to work aboard Vietnamese ships and crews members being Vietnamese citizens allowed to work aboard foreign sea-going ships". Article 2.- This Decree takes effect 15 days after its signing. Article 3.- The ministers, the heads of the ministerial-level agencies, the heads of the agencies attached to the Government and the presidents of the People�s Committees of the provinces and centrally-run cities shall have implement this Decree.
